Terms of Service

1. Description of Service

ComChord is a standalone platform that "listens" to recorded conversations and provides leaders with AI-generated insights to help improve the quality of their interactions. Core features include conversation scoring and AI-generated summaries. There are currently no real-time features.

2. Acceptance of Terms

By accessing or using the ComChord services—including our website, applications, and other platforms (collectively, the "Service")—you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that:

  • You are at least 18 years of age.
  • You have not been previously suspended or removed from the Service.
  • Your use complies with all applicable laws and regulations.

4. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration.
  • Keep your login credentials secure.
  • Notify us immediately of any unauthorized access or use of your account.

You are responsible for all activity that occurs under your account.

5. Use of the Service

ComChord grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.

Use of the Service is subject to the following restrictions:

You agree not to:

  • Record calls or conversations without obtaining proper consent from all participants.
  • Use the Service for any unlawful, abusive, harassing, or harmful purposes.
  • Use the Service in connection with surveillance, HR enforcement, or political campaigning.
  • Scrape, extract, reverse engineer, or attempt to derive source code or algorithms from any part of the Service.
  • Use the Service to build, train, or inform a competing product or service.

6. User Content

You retain ownership of any data, recordings, or other content you submit through the Service ("User Content"). You grant ComChord a limited license to use this content solely to provide and improve the Service.

User Content may be processed using third-party AI providers, currently including Gemini, to deliver features such as summarization and scoring. User Content is not used to train internal models. As of now, we do not store AI-generated outputs. Please refer to our Privacy Policy for more details.

You represent and warrant that you have the rights to provide your User Content and that it does not violate the rights of any third party.

7. Privacy

Our use of your personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms.

8. Subscriptions and Payments

Some parts of the Service may be offered on a subscription or usage-based basis. Details of pricing tiers and usage limits may change as we refine our offerings. We reserve the right to introduce or modify pricing plans, usage thresholds, and related terms. Payments are non-refundable except where required by law.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or are creating risk for other users or for ComChord.

10. Disclaimers

The Service is provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, ComChord shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising out of your use of the Service.

12. Modifications to the Service

We may modify or discontinue the Service or any part of it at any time, with or without notice. We are not liable for any such modification or discontinuation.

13. Beta Features

From time to time, ComChord may offer access to beta or experimental features. These features are provided "as is," may be modified or removed at any time, and may not have full support or documentation.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the Service or by email. Continued use of the Service after changes are effective constitutes acceptance of the updated Terms.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or the use of the Service shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in the State of Delaware, United States.

By agreeing to these Terms, you waive your right to a jury trial and to participate in any class action litigation.

16. Governing Law and Jurisdiction for Enforcement

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. The parties agree that the federal or state courts located in the State of Delaware, United States, shall have exclusive jurisdiction to enter judgment upon any award rendered by the arbitrator.
